Under the NSW Housing SEPP, a granny flat can usually be approved as Complying Development — a ~10–20 day certifier approval — if the block ticks these boxes:
- Minimum lot size 450m²
- Max 60m² of living area for the secondary dwelling
- Setback, height and site coverage within the code for your zone
- No disqualifying overlays — flood, bushfire or heritage can push you to a DA
Miss any of these and it's a council Development Application instead — slower and more expensive. The only way to know which applies is to check your specific block's zone, size and overlays.
